Terms and Conditions
Scope
These terms and conditions apply to all orders placed through this platform between Maik Menzel and customers — both consumers and business customers within the meaning of §§ 13, 14 BGB (German Civil Code). Deviating terms proposed by the customer are not recognised unless Maik Menzel expressly agrees to them in writing.
Formation of contract
The customer uploads sketches, photos, or drawings and describes the desired order. Maik Menzel then prepares a non-binding fixed-price offer. The contract is only formed once the customer expressly accepts this offer in the customer area. No costs are incurred before acceptance.
Nature of the service
Maik Menzel owes the careful, professional creation of the commissioned DXF file based on the templates and information provided by the customer (a contract for services). The customer is responsible for the accuracy, completeness, and usage rights of the templates provided. Missing or unclear information may extend the processing time.
Prices and payment
Payment is due in advance: after the offer is accepted, Maik Menzel issues an invoice, and work begins once payment is received. Invoices are due within 14 days. All prices are net prices plus statutory VAT.
Express processing
On request, express processing within 24 hours of payment being received is available for a 50% surcharge.
Usage rights
Upon full payment, the customer receives a non-exclusive, unlimited usage right to the created DXF file for the agreed purpose. Until full payment is received, this usage right is subject to a condition subsequent.
Customer account
The customer must keep their access credentials confidential and inform Maik Menzel without delay if there is reason to believe a third party has gained knowledge of them. Either party may terminate the customer account with reasonable notice.
Warranty and liability
Maik Menzel is liable without limitation for intent and gross negligence, as well as for injury to life, body, or health. For the slightly negligent breach of material contractual obligations (cardinal obligations), Maik Menzel's liability is limited to the foreseeable, typical damage. Liability for slight negligence is otherwise excluded. Mandatory statutory liability provisions, in particular under product liability law and consumers' recourse claims, remain unaffected.
Right of withdrawal for consumers
Consumers have a statutory right of withdrawal, explained separately below. If the customer expressly requests that processing begin during the withdrawal period, and confirms awareness that this causes the early loss of the right of withdrawal, the right of withdrawal expires once the service has been fully performed.
Confidentiality
Both parties will treat confidential information exchanged in the course of the collaboration, in particular uploaded templates and order details, as strictly confidential and will not disclose it to third parties without consent, unless a statutory disclosure obligation applies.
Changes to these terms
Maik Menzel may amend these terms with effect for the future, in particular to adapt them to changes in the law or new service components. Customers will be informed of any changes by email in good time.
Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is the registered seat of Maik Menzel. Should any provision of these terms be invalid, the validity of the remaining provisions is unaffected.
Right of withdrawal for consumers
For the purposes of this notice, a consumer is any natural person who enters into the contract for a purpose that is predominantly outside their trade, business, or profession.
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded. To exercise your right of withdrawal, you must inform us (Maik Menzel, Nordufer 24, 26203 Wardenburg, email: moin@zelkon.de) of your decision to withdraw from this contract by means of a clear statement (e.g. by email). To meet the withdrawal deadline, it is sufficient for you to send your notice of withdrawal before the withdrawal period expires.
Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal. We will use the same means of payment you used for the original transaction, unless expressly agreed otherwise; in no event will you be charged any fees for this reimbursement. If you requested that processing of your order begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of services already provided up to the point at which you notify us of your withdrawal, compared with the total scope of services provided for in the contract.
Early expiry of the right of withdrawal
Your right of withdrawal expires early if we began processing your order only after you expressly requested this and at the same time confirmed your awareness that you lose your right of withdrawal once the contract has been fully performed.
